Leslie Wise, the CEO, practiced for 25 years at the bar from Chambers in Inner Temple.
Using expertise gained as a Chartered Accountant he quickly developed a civil practice specialising in Company Commercial Business and Insolvency.
His practice frequently in the Winding up courts and before the Registrars in the Bankruptcy rooms.
It also saw him in the criminal courts. It is difficult explaining to a creditor that the bounced cheque he holds is NOT evidence of fraud. The question is what was the intention of the writer when he issued the cheque. Unfortunately all the debtor has to say as a defence is that he thought that by the time the cheque was presented for payment other funds would have arrived! Most unsatisfactory. On the other hand trading with intent to defraud creditors is criminal. So is re-using the name of a company wound up insolvent.
Generally debt is a civil matter. As a barrister he acted both for debtors and creditors.
In an important case, faced with his client’s being disqualified from acting as a director he devised a raft of guarantees of solvency sufficient to persuade the Court not to deprive him of his livelihood.
On the other side he has drafted schedules of delinquent behaviour (transfers at an undervalue, disappearing assets, self-preferment) sufficient to have rogue directors disqualified and has helped cheated creditors recover after a company has re-appeared using a similar name to the one of the company just put into liquidation.
We collect for all trades. If any groups predominate we are perhaps most used by commercial landlords, by architects and surveyors, by dentists, by consultants and (our most challenging debtors) by psychiatrists. At the bar Leslie Wise has regularly written articles for the Solicitors' Journal, Solicitors' Gazette and Accountancy Amongst the most read of his articles was one on Reservation of Title and another “Landlord, Help Yourself” - the commercial landlord’s ancient right of distraint.
